I've just received a DSEAR assessment from a subcontractor. It's for polythene sheeting being used as temporary partions on a building site. Dangerous? Explosive?
Has anyone else had anything similar? Is DSEAR the least understood set of regulations out there?

Any bets it has been asked for before by another client/PS/Contractor who thought that DSEAR concerned any flammable material. It is highly unlikely a subcontractor would have ever gone down this route "unassisted" - using the word to be totally polite.

DSEAR Reg 2 - Definitions:-
Please refer to L138 p8 - 15. Dangerous Substances & Explosive Atmospheres Regs, ACoP & Guidance.
A "risk assessment" under DSEAR for a classifiable "dangerous substance" is not necessary just because it is a dangerous substance. For it to require a risk asessment under DSEAR, it must also fall into the category of first being capable of producing an explosive atmosphere that will be accompanied by the specified hazards [see Reg 2 Definitions] and also be an integral part of the actual process [see Reg 2 Definitions] rather than as a seperate, potentially flammable substance or item that perhaps encloses the process.
For the example given, I would expect to see an MSDS for the sheeting; a clear identification of how it is going to be used, and for fire risk - a specific Fire Risk Assessment [FP(W)Regs soon to be the RRFSO] that addresses the actual use in the actual circumstances of that occasion.
It may also require other RA's such as a Confined Spaces RA, W[H,S&W] RA and others relevant to the circumstances.
