The footpath and entrance to one of our health centres is adjacent to a domestic premises where the brick (6ft) boundary wall appears unsafe (tree routes growing up into it and cracked brickwork). The boundary wall belongs to the domestic premises and the footpath adjacent to the wall belongs to us. The footpath is used by centre users and also by children attending the nursery building at the rear.
I plan to write to the owner raising our concerns and asking for the wall to be made safe but I am not too hopeful. Has anyone dealt with a similar scenario and am I correct in saying the responsiblity lies with the owner of the boundary wall?

I suggest you involve the LA Building Control Office. They should be able to serve a notice on the owner...

Before writing, do the civil thing and telephone to resident to ask if he/she has a few minutes to spare to discuss the condition on the wall.
Explain that you have concerns and rather than just writing, you felt it better to ask if they were aware of its condition and ask their opinion.
Assuming you get a civil reply - and preferably a face to face chat - you MUST explain that it is absolutely necessary that you have to write a short letter to them about your concerns, just to ensure that you have been seen to do the right thing under Health & safety regulations that apply to the centre, and that you also have to copy the letter to the local authority for the same reasons.
This should produce the desired results.

Thanks Fred I did try to do the 'civil' thing by phoning first, but as I said the house is a domestic premises not a commercial enterprise/public building so without knowing the name of the house owner it is difficult to telephone.
