Posted By ddlhood I visited a site recently and noted a large non compliance with PPE. The management claim some workers had been allowed to "opt out" of wearing some PPE and this had been allowed. Is this legal and if so, why is this option allowed?

Posted By Chris Pope Not allowed, by definition PPE is chosen as a result of risk assessment: in a recent test case a worker who claimed he could not wear the PPE for health reasons, and was unable to be relocated within the business was sacked and the sacking was upheld by a tribunal.
