Posted By James Sneddon The new smoking law is being introduced in Scotland on 26 March 2006 with a wide spread smoking ban in enclosed public places, including workplaces. According to the guidance material issued by the Scottish Executive residential accommodation is exempt.
Any comments on why residential accommodation should be exempt based on my general comment as follows:
In my view non-smokers especially children in a residential property with smokers, are at a greater risk compared to public shopping malls etc due to the lack of proper ventilation in residential properties.
Also what would happen in the sceanario of using your residential accommodation as a place of work? Would the law still apply?

Posted By Descarte Is this act not to do with work as I don't see why the children issue would be relevent unless they are on work experience, and in a residential home the home owner/parent would be responsible for whether they smoke around their own children I guess.

Posted By jackw. Hi, there are a number of past threads on this. Sorry don't really see you point re children. Also think you need to have another look at the new legislation and guidance.. smoking will only be permitted in residential units in a designated smoking room which has to meet certain criteria... ventilation, self closing doors etc.
