I need to know the legal requirements regarding the provision of edge protection on a tidal harbour wall. The area is open to the public and at low tide offers a sheer drop of severn metres onto bedrock.

any suggestions would be most welcome.

Sometimes the frontagers will be bound by contract, planning requirement or covenant to provide edge protection but in the absence of these it will be a matter for fulfilling general duties under the Health and Safety at Work, etc Act, Occupiers Liability and Common Law. Risk assessment is the advised approach to the subject taking into account who would be at risk, accessibilty, presence of unsupervised children, etc, etc. RoSPA have some published guidance on this subject and you could speak to their Water Safety Advisor (Peter Cornall)
