Hi All,

We are about to embark on a 20 week project to fit a small warehouse with Laboratories and need to appoint the relevant people. I believe in regulation 6 of the CDM regs it states that the same person may take up the role of both Planning Supervisor and Principal Contractor.
First of all does anybody know where I can find this regulation on the net today (a bit strapped for time) and also does anybody have experience of handling a project under these conditions and could advise me of any problems or concerns they would have with this. I know that we have to ensure that the Principal Contractor is competent to take up both these roles, I am just concerned that they may have a conflict of interest in doing so.

Any views would be much appreciated,

Scott, read the SI at http://www.opsi.gov.uk/s..._19943140_en_2.htm#mdiv6 Section 6 para 6b States"(b) the appointment of the client as planning supervisor or as principal contractor or as both, provided the client is competent to perform the relevant functions under these Regulations." The whole SI is there to read but I think this answers your quetion.

Scott one thing I would add re potential conflicts of interest if the PC is also going to at as PS what are the company arrangements for doing this i.e. who within the organisation has what responsibility, how would they deal with a conflict of interest and what experience do they have of acting in a dual role?

I have been involved with a similar set up of the PC acting as PS and these were questions that the HSE asked.
