Can anyone help me out with Health & Safety Law in Dubai. Does English law stand for English companies out their?. Any guidance would be appreciated, or point me in the right direction for references

English companies operating in foriegn countries should always abide by local applicable guidelines, laws and regulations, but often these fall short of UK/EU standards. Therefore as a UK company it may be considered best practice to work to the UK standards in such countries, though I believe it is not compulasory most companies often also have corporate/global guidelines as well.

The UAE have an overarching set of safety laws but they are pretty general. There is however a specific set of regulations for Dubai which were issued in 1980. Get hold of a copy of these (I couldn't get hold of them on the web so you might have to ask a local law firm to provide). The regs are pretty good (although they do discriminate against foreigners to a certain degree!!). That said it is always a good idea to follow the local laws to the letter and then try to improve to an English standard or spirit of English law - this will help if you get a case against you in Private International Law which takes into account the "controlling voice" of the company. Do bear in mind though, that when you are trying to invoke English standards you may be creating a problem for the future if the locals involved in maintenance don't know that the systems you have put in place are different to what they are used to. Difficult problem in practice (rather than the theory)!!

As an addendum to Rob's posting, I would also point out that all the labour laws in Arabic countries are published in Arabic and then translated into English, so if it's the 'letter' of the law you're after make sure the translation is an accurate one.

Hi CFW,
I am working here in UAE (sharjah) since 2002 as safety inspector.
As other responders stated the HS related legislations are very general.
Anyhow in dubai the municipality is responsible of such rules (i have no idea about the enforcement mechanisms)

in the link above you will find such rules which titled as environment protection systems & guidlines (but many H&S rules are included)(the good news for you it is in english)
I hope this of use.
note many companies who are interested in HS here using OHSAS 18001, ISO 14001, BS8800 etc and sometimes they even use other national HS regulations (US/UK but almost UK).

You can also have a look at the Following:
UAE Labour Law - Federal Law No (8) of 1980 Ministerial order no (32) year 1982. Article 1 to 28.
Article 91 to 101 ( Industrail safety, preventative measures, health and social care for workers) You might also want to have a look at Disciplinary Rules artcile 102 to 131 specially article 120(d) which states you may dismiss a worker without notice for contravening safety regulations.
Article 142 Compensation in respect of employement - Accidents and occupational diseases
Ministerial Decision No. (37/2) year 1982 Medical care which employer is obliged to provide to his workers.
All of above can be found in the UAE`s Labour law handbook.
Also the Code of construction safety practice. Adopted under Local Order 61/1991 The environmental Protection Regulations in the emirate of dubai.
You can find the above manuals at the Dubai Municipality office in Deira and the technical guidelines on their website.
and the Environmental protection and safety section of Environment Department`s Environmenatl Technical Guidelines.
and if all of above fails,(and it will) depending on the consultant on the project you revert to the applicable international standards and legislation like BS, OSHAS, etc.
It also depends where the project u are going to work in is located, if it is in the TECOM area they are a bit more strict and able to enforce health and safety than the general dubai municipality area.Last I dealt with them they were busy complining their own regulations.
