Good Morning,
I am looking for some sources of information regarding the above, in particular its requirements and expected impact on employers liabilities insurances.
I have already contacted our insurers but as it can take some time for responses I am also looking for other sources of information.

sorry alan this is a first for me , but you have my attention as i handle our litigation cases. does it relate to the person injured or the defending partys attempt at recouping cost of defending cases?

Hello Roy,
I belive that the legislation was due in April 2005 but subsequently delayed to allow insurers to prepare.
The legislation will basically enable the NHS to recoup their costs for treatment for those injured due to an accident in the workplace via employers liability insurances. Some of the examples I have seen include flat rates of £150 per ambulance journey, £437 for treatment not requiring hospitalisation, £582 per day for treatment with hospitalisation.
Estimates for increase in Employers Liability insurance for SME's has been predicted at around 8%.
I'm looking for some in depth information on the requirements of the legislation and how insurers may adjust ELI premiums for companies that can demonstrate an effective health and safety management system and if will there be any recognised standards that they will accept.
Its not a new concept for the NHS as they have been able to recoup costs for treatment for road traffic accidents and this new legislation is an extension of that principle (I belive).
