We have currently taken over a small firms em-ployees on investigation into Accident records I found that two of these employees where involved in Accidents that where RIDDOR Repotable (approx 3yrs ago)

Now that we have taken over these employees if one should decide to make a claim for his injuries sustained could this come back on our Company (TUPE Transfer)

This is should not be the case, as they would be covered by the employers liability insurance that was in existence at the time of the accident.

This is one of the reasons why we have to keep a copy of our insurance for 40 years, so that in the event of a company going bankrupt etc, situations like this would be covered

The answer is yes, you would be liable for the injury. However, as the previous respondent stated this should be picked up on the employers liability insurer who provided cover at that the relevant time.
