Posted By Anwar Afzal We are landlords for a foreign consulate and my concern is whether the tennent can claim diploamtic immunity for breaches of health and safety because i am not happy with certain procedures in place and it may affect some of our other tennants as this building is a multi 0ccupied one although they have sole access to a whole floor and seperate entrances etc.

If it were me, I would contact the Foreign Office, local HSE and local EHO for expert advice, stating the problems and possible scenarios, then asking for practical technical help. Perhaps a quick Google search on "Diplomatic Immunity" may bring up information regarding areas where tenants are exempt from current british laws? Best of luck!

Posted By Glyn Atkinson Just a quick afterthought - if diplomatic immunity means that they are acting on their own laws whilst in a foreign land, then what health and safety laws apply in the home country - worth another search on the net? Depends on the nationality and development, of course!

Posted By Anwar Afzal They are trying it on, they tried it before do to with rent arrears but that was a civil issue and as such does not come under immunity but this might becuase its a criminal situation

The great majority of countries around the world do have some kind of H&S legislation. Actual enforcement miiight be tricky but it could give you a starting point. Only other point that comes to mind is to get the local fire officer in. I think they do have powers of inspection of any building or premises. At the limit, it is possible that they could declare the building or part of it "too dangerous for habitation" Have a nice day. Posted By Anwar Afzal Merv These tenants affect around 150 flats above them and to the side, and they are at risk. This consulate is a south asian one, who unfortunately is not hot on health and safety at home.
