Posted By J Knight Hi Folks, This is about the Duty of Care. Acording to the COP published by the EA it isn't actually necessary to follow your licensed waste carrier to the dump in order to discharge your duty of care, provided you have all the transfer notes and other assurances of probity. One of our Business Managers whose background is in furniture re-cycling and re-use says that her former trade body advised its members that it is necesary, and other people have said the same. I'm tempted to go with the EAs advice, as the alternative is pretty onerous, so exepriences, thoughts, advice etc as always most welcome, John

Posted By David Muldoon John I'd suggest that rather than simply follow your waste carriers to wherever it is they go, you first of all you develop a programme which demonstrates that you are proactively discharging your DoC responsibilities. For example, you may wish to 'follow' a waster carrier once a year, conduct a DoC audit on a landfill site every other year and so on. If you have an EMS/14001 then these can/should form part of your internal audit process. Obviously, the frequency of these audits depends on the size of the business and the resources available. Posted By J Knight Hi David, Thanks for that; I wasn't suggesting following them everywhere (they might get the wrong idea ;-)), just something on the lines of an annual check etc. My query isn't so much 'is this part of ISO 14000', but 'is it necessary'. I want the Charity to adopt ISO 14000, but we do have very limited resources, and it may be that in adopting an environmental management system we cannot aim for 100% compliance; we do want to exceed the statutory minimum, but is following waste carriers actually neede to protect us from breach of DoC? John

If you ensure your order with the Carrier requires them to supply you with copies of their transfer note to the Landfill site/ disposal point on request, you can monitor the paper trail of any load on a random desktop basis. I feel that if you feel the need to follow a load, to check where it is going, then you have the wrong carrier as you are feeling you cannot trust him. Choose a reputable carrier and like you their business depends on its continued good name and legal compliance for its existence. Bob
