Hello all,
Can anybody advise on whether there have been prosecutions for employers not completing OSR1 (Registering with enforcing authority)?
I have had a couple of occasions where I have advised clients to register only for them to say that the local authority know where they are anyway because they pay business rates and they cannot see the reason for completing yet another bit of paper. I am reluctant to respond by saying that they must register because it is a legal requirement - any ideas how best to pursue this?

Hello Malcolm,
I'm not sure of prosectutions but you could check the HSE prsecutions database.
This is an extract from the HSE
'If an employer intends to employ anyone to work in an office or shop, they are required by section 49 of the Act to notify the appropriate enforcing authority beforehand. They must provide specific details as laid down in the Notification of Employment of Persons Order 1964 (SI 1964/533). This is done by completing form OSR1 and sending two copies to the appropriate authority as shown on the form.
Failure to comply with this requirement is an offence.'
The Act reffered to is the OSRPA.

Hi Malcolm,
Just as a clue, we 'found out' last year that the bulk of our 400 Charity shops had never been regsitered. Nobody made a fuss, we were just advised to register ASAP and we have done. Some of these premises have been trading for 50 years,

There must be thousands of employers nationwide who will do everything to the book in all aspects of their business and know absolutely nothing about this requirement - the charity shops mail proves it!

I think I understand your question: go to the HSE website www.hse.gov.uk. Go into the website and type OSR1 in the search HSE website at the top right corner. It is quite straighforward from there.
