Posted By paul debney What do people think of a company policy that requires employees that leave within 3 months of starting, to pay back the cost of safety shoes upon leaving. Do you think that the company is breaching the HSAW act in making persons pay for PPE in doing this?

Posted By The toecap Yes. If the company is being that bad perhaps they should ask for the footwear back. If i had money taken off me for this i would call it ' illegal deduction of pay' and got to a tribunal to get it back. Also, if asking for the money back there has to be an agreement of the method to be used. ie all at once or £2 a month.

Posted By Diane Thomason Paul Yes. The company was obliged to supply the shoes free of charge for use at work. The employee was at work for 3 months. If he pays the cost of the shoes now, that means the employer did not provide the PPE free of charge while he was employed for 3 months. Wave a copy of the HSE PPE leaflet under their noses.

Posted By Kevin Drew I tend to disagree with both of the previous postings. The easy option would be to return the safety shoes when leaving. If leaving after only three months, and keeping the shoes, I don't think it is that unreasonable to expect the individual to make a payment. What if the person left after a few days, would you still expect him to walk away with essentially brand new shoes FOC? The line has to drawn somewhere and three months is not unreasonable. Posted By paul debney Im no jobsworth, Im in the process of getting some info to the people that matter, on getting this policy changed, i.e.My manager!. All I wanted was some opinions from fellow H&S people. As you can see from the other PPE thread for 'special constables' interpretation is not always 'black or white'.

Posted By Adam Hammerton We have recently asked a similar question but for RPE for asbestos workers following the review of a contractors policy. HSE are quite happy for employers, as long as it is stated in the T&C's, to recoup the cost of RPE (a lot more expensive than footwear agreed) if it is not handed in at the end of employment. I can only assume the principle stands for all PPE.

Posted By Glyn Atkinson Our standard safety boot C/W steel toecap come in at under a tenner, bought in bulk amounts - 1000 + employees. 60% + have this type of footwear as standard.
