If a construction project falls under the control of the LA, then it falls outside the scope of the CDM regs....? Right. But does a safety plan still need to be submitted by the LA to the contractor? Answers on a postcard please

Along a similar line, there was some discussion of the application of CDM to office refurbishment in a thread posted on this forum on 08/11/2005. It might be of some interest.

Further question - do road repair projects need to be considered as CDM (repairs rather than new roads)and what exactly would you put in the H&SF File for hand over?
Not sure any of the guidance helps with either of these questions

If CDM does not apply there is no legal requirement for a safety plan, even if it may be a good idea to have one.

I think you are mixing up two aspects here. LA works are enforced by the HSE and not the LA therefore all LA construction work is potentially under CDM regime.
There is currently a dis-application for premises enforced by the LA where there are minor works but this is going to disappear in the 2007 version, at this moment!!
So the answers to your questions depend on whether there is need to notify and how it is to be managed. But design is always there!!!!!:-)

To the toecap: you're not right, your wrong. CDM applies to Construction Projects managed by LA's just as it does to any other Client/Designer organisation.
