Posted By Richie H I am almost certain that road vehicles e.g. Ford Focus etc. are not classed as work equipment, even if supplied as a fleet vehicle, but cannot find this written anywhere... so perhaps i am mistaken. The reason i ask is that i am now finding myself tasked with carrying out a risk assessment on such vehicles - PUWER on NOT PUWER that is the question? Look forward to your responses and any assistance on carrying out a suitable assessment on a vehicle (not FLT etc) would be appreciated. Cheers, Richie

Posted By Brian Hagyard The following is taken from the HSE publication Safe Use of Work Equipment, it’s a guidance paragraph and not an acop paragraph so has the usual associated issues, but it states, “Motor vehicles which are not privately owned fall within the scope of PUWER 98. However, the more specific road traffic legislation will take precedence when these vehicles are used on public roads or in a public place. When such vehicles are used off the public highway and the road traffic law does not apply, for example on a dock road, PUWER 98 and the HSW Act would normally take precedence unless relevant local by-laws are in operation - for example, road traffic by-laws at some airports. Car drivers should hold a Department of Transport driving licence and cars should be maintained to the normal standards required for use on the public highway, ie they should have an MOT certificate, where necessary, or maintained to equivalent standard where statutory testing is not a legal requirement” Does that make it any clearer for us? Posted By Richie H Brian, It does thanks - I will go down the road (excuse the pun) of classing as work equipment for the purpose of my risk assessment with reference to Road Traffic legislation as they are used on public roads, but provided by the Company. Thanks
