Posted By SD Hi all, Just be thrown an e mail by 'the boss'(not Bruce, he is still following the music career) to check out the possibility of liability for road deaths and see if this could be affected in Irish Law.
Our company has a lot of employees out on the road driving. From looking at the Safety, Health and Welfare at work Act 2005 the law is not explicit on driving (or Road risk), the 2005 Act merely requires that we are to manage and conduct all work activities, in such a way, so as to ensure, in so far as is reasonably practicable, the safety, health and welfare of people at work --- for many driving is a workplace activity. Any opinions on this subject would be appreciated. Thanks in advance SD

Posted By oneill SD, If a person carries out their work from a car/truck etc that I think is then classified as "a place of work", therefore 2005 act would apply, for instance the smoking Ban applies to cars trucks etc if used for work. I could be completely off with this, so feel free to correct me if i'm wrong.

While corporate manslaughter is due to become an offence in N. Ireland I am unaware if the Irish Government has any ambitions to follow suit quickly. I am assuming if an Irish Company is convicted of severe negligence under the SHWWA 2005, the fines and penalties imposed will be as set out under this act, ie, Directors fines up to 3Million and/or 3 years imprisonment.
