Posted By Stuart Caroline A pal of mine has come to me with a question - A tanker driver while delivering fuel sratched a car as has been given a written warning for failing to carry out his duties effectively. Facts 1. Car was parked in a marked danger zone, parked there by a member of the garages staff. 2. Banksman did not give any signals and only told the driver when he had scratched the car. 3. Driver said it was not to good a situation to reverse into but was persuaded by the banksman to attempt it. 4. The banksman is the garages competent person. On the basis of this who is should be held accountable and is there any other known case of an incident like this. Cheers Stuart

Posted By Merv Newman Sorry, but it looks as if the driver is at fault. He has full control and "ownership" of his vehicle. Even though he may take advice from another person. So he was reprimanded and, I suppose, his employer pays for repairs. Merv

Posted By Martyn Hendrie His employer may well be taking the view that if a car was in the danger zone he should have refused to make the delivery until it was moved. The reprimand may be for not following laid down procedures.

Posted By joe perrins How fortunate it was only a bit of metal that was damaged and not a pedestrian killed or injuried. Had the banksman received correct training by a qualified assessor?
