Hi all,
I hope that my question can be answered in this forum:
If i am doing a fire risk assessment on a small ground floor newsagents on a parade of shops, is it the responsibility of the shop owner to ensure that a fire alarm system is in place to warn their neighbours/the tenants above them in the event of a fire (i.e. do they need to install a fire alarm control panel with sounders positioned/linked to these areas?).
Or is this the responsibility of the landlord/managing agents?

Hi Howard !
Whoever is in control of the premises is the 'Responsible' person for the fire risk assessment, however they must be 'competent' or get someone who is to carry out this assessment. Hope that helps.

I'm having a bad day haha ! Well it is Sunday after all. Erm did the premises have a fire certificate originally ? You can use that to gain info from towards your R/A, as to the original question i would think that whoever is managing the premises would be responsible for installing such items as smoke alarms or fire alarms,also testing of this equipment too. He would also need a Fire action plan and inform his employees of the drills and make records of this too.

I assume that the tenant above you is residential rather than an office/business. The fire separation between your shop and the accommodation must be a minimum of one hour and the exit route from the 'flat' must not be through your shop. Assuming that the standard of fire separation does comply with the minimum one hour and the occupants do not have to pass through your shop to exit then there is no requirement to install an automatic fire detection and alarm system. However, if as a result of your fire risk assessment you have determined that there is a need to provide warning for the occupants above, then it is as a result of the risk you have created. It would therefore fall to you to provide the warning system.
