Dear colleagues. This is for those of you who have a decent working knowledge of RR(FS)Order 2005. Does the Order make mention at all of consulting or communicating with union safety reps? Seems a strange omission if not?

Are you approaching this from the angle of disagreeing with the risk assessment? As the results of risk assessments are diseminated MHSR to all conserned and as such the RRO doent need a specific clause regards consultation

No, I am approaching this from the fact that Fire Regs are enforced (mostly) by the Fire Brigade and MH&SWR enforced by HSE. Do the new fire regs mention union safety reps at all and are Fire enforcement officers aware that union safety reps exist?

I agree with Peter.
The SRSC Regs put the onus on employers to consult with the safety reps on any issues regarding H&S and thats why you'll find that any new regs dont specifically mention the need to consult with reps or indeed employees.

Richard: non-union ROES (Representatives of Employee Safety) exist too! I believe that the '96 Consultation with Employees Regulations has this area adequately covered.
Has to be remembered that new fire regs cover premises other than those that may have an employer/employee relationship within.

There is a requirement in the regs to pass on the information to your employees & the self-employed from outside under takings (Reg 20)- so consultation with employee representatives or union reps seems in-material.
You are legally obliged to carry out a fire risk assessment (Reg 9) and pass the findings / controls to your staff

Merely trying to find out if the fire authority are aware of union safety reps in the same way as HSE inspectors are. HSE will actively seek out safety reps when they visit. I will ask a fire enforcement officer (thanks for that P)! But was hoping that someone may know...

The answer is yes. Section 41 refers to the SRSC. There is a requirement to consult with employees or their reprsentatives. As an ex fire officer I can tell you that most fire officers are very aware of unios safety reps etc.
