Hello all. Would it be acceptable for a person without a licence and who has not attended a reginised training course to drive Fork Lifts and palett trucks if they were deemed to be "Under instruction/supervision" by qualified drivers?The "Instruction/Supervision" mentioned of boils down to the qualified person being in the "area" where the non qualified person is operating the fork lift. You can probably tell that I have my own views on this, what do you think?

If the person has historically driven a FLT then maybe you can deem him "Competent". If not I think that you would be taking an unacceptable risk.

Either way, I would advise getting him formally trained ASAP.

If you reverse the question - let's say he was involved in a serious accident. How could you justify this to your Insurer / HSE inspector?

Incidentally I doubt that your insurance would cover un "untrained" driver regardless.

No, its not a situation I would be happy with, and theres no way that the supervisor could keep an eye on the driver at all times. Remind the supervisor that he also has responsibilities and could find himself open to prosecution for allowing an untrained person to operate equipment.

I believe that "under supervision etc" as it relates to the acop related to the period whilst undergoing training. As the previous posting said, try to explain your reasoning to a HSE or LA inspector who will no doubt ask you to demonstrate what FLT training qualifications your FLT driver holds. If in doubt have a look at PUWER Reg 9(2)

Wait for the HSE inspector to call after any accident, and his first question is likely to be - "can you show me this person's training record as proof of competency to drive this vehicle ?"

Every user a competent driver - trained by certified training provider to national standard - the preferred safe option, in my humble opinion !

No one drives FLT's on my site without this requirement in place, and refreshers done inside 3 calender years from initial training period.

Remove any drivers after any accident or major incident for refresher training - may be harsh and costly, but satisfies both HSE and our insurers!
