I am trying to find some details on a recent prosecution whereby an individual was driving home after several excessively long shifts and was involved in an RTA. My understanding is his employer was prosecuted under s3. Does anyone have the details or could point me in the right direction - have tried google but without sucess.

I believe this is the one. Sorry, but I dont have any more information than the following,

In what is thought to be the first case of its kind in the United Kingdom, an employer has been prosecuted for the death of an
employee outside working hours.
The company, a potato haulage business, was fined £30,000 and ordered to pay £24,000 costs
at Cambridge Crown Court for a breach in Health and Safety
Legislation following the death of one of its workers in a car crash in 2002.
The employee worked 11 days without a day off prior to the fatal crash. An investigation revealed that during that time he worked
an average of 17 hours a day and was getting 3 to 4 hours sleep a night. He was thought to be
suffering from chronic fatigue and had fallen asleep at the wheel of his car on his way home. His car drifted into the path of an
oncoming lorry.
The company admitted failing to ensure the health of its workers and the public.
