A child of my acquaintance was injured in a bus; the mother of the three year old had loaded her onto the bus and was in the process of packink away a pushchair, when the driver took off, causing the girl to stumble and hurt her mouth. She was taken to hospital, but no treatment was needed, apart from observation. The bus company has advised that it is not reportable under RIDDOR, while I am advising that I think it is and shopud be pursued as such. Does anyone have any similar incidents which they may be able to advise on, or indeed any comments?

Member of the public taken to hospital from the scene of an accident reportable under riddor. Question is was she taken from the scene or after the fact. If it was the first scenario then the bus company should report.

She was taken after the event as transport had to be arranged to get them from home (their destination) back to the Hospital. Does this, in your opinion make it non reportable, as I am a bit lost on this,

As Bob says, it is non reportable as the injured person did not go to hospital from the scene of the accident.

I'm sure I would go RIDDOR on this. We have had similar discussions about employees who get hurt, go home and then go to the hospital and get a week off. They are RIDDOR.

And what is the harm in reporting ? It certainly makes you get all your ducks in a row which can only help if there is a subsequent prosecution.

For this little girl I would sue. Or give the driver a good thump up the side of the head.

Don't really mean that, do I ?

I used to work for a major bus company on Merseyside and can speak from experience - RIDDOR unless RTA then police investigate.

the key is in your scenario is you state "employee" who goes home then to hospital.

If he/she is unable to carry out their normal duties for over 3 days then that is an over 3 day injury (RIDDOR Reportable).

A child on a bus is a member of the public therefore the over 3 day rule does not apply.

Unless a member of the public goes to hospital from the scene then is not RIDDOR.

So I reiterate this scenario is not RIDDOR reportable.
