I am currently involved in an accident investigation involving a 9 tonne dumper truck which overturned on a construction site. I contacted Caerphilly HSE to clarify whether it was reportable under Riddor (section 1) to which i was instructed that it was, when i informed the main contractor of his requirements to report under Riddor he stated that it was no notifiable. HSE clarification was again sought from Caerphilly who initially said it was but then said it was not. Has anybody out there suffered the same type of incident and were they instructed and did they actually report under Riddor? Fortunately on this occasion the driver sustained no injuries as he was wearing is safety belt, but we may not be as lucky next time.

Hi Phil,

RIDDOR lists the following with respect to overturning:

The collapse of, the overturning of, or the failure of any load-bearing part of any-

(a) lift or hoist;
(b) crane or derrick;
(c) mobile powered access platform;
(d) access cradle or window-cleaning cradle;
(e) excavator;
(f) pile-driving frame or rig having an overall height, when operating, of more than 7 metres; or
(g) fork lift truck.

A dumper truck is none of these.

Its not one of those items on the list, however, surely its a dangerous occurence and should be reported?

Or are we now saying that its OK for dumper trucks to overturn?

I don't think anyone is saying it's OK.

However dangerous occurrence is a legal definition, not a general term for anything dangerous that might happen. If the list quoted from RIDDOR is the only one that might apply (I have not looked up the guidance myself for this reply) then no it's not reportable. Doesn't mean the company involved isn't taking it seriously - clearly since an investigation is taking place, they are.

Agree 100% with previous response - Definitions of Dangerous Occurrences under RIDDOR is relatively clear & you must stick to this list.

There are plenty of Dangerous Occurrences that require suitable investigation & action - but fall outside the remit of the definition. HSE do not need to investigate all of these, they are stretched enough as is.

Sorry.....didnt mean "its ok" as in trivial, meant in such a way that it wouldn't need reporting. I appreciate that its a worry!

I had an inspection from my local LA last Thursday and although I thought he was a reasonable chappy, he got slighty upset that I hadn't reported that a "toast rack" style racking had collapsed due to overloading. I said then that I thought it wasnt reportable, but he insisted, quite catagorically that it was as a dangerous occurence.

Based on that, I would have thought that a 9 tonne dumper overturning was equally reportable, but after checking RIDDOR, it seems its not. I apologise for my mistake.
