Am putting together a training course for managers and am trying to illustrate the point that you don't need to have an accident to endure costs and trouble from poor H&S.

Can anyone remember the details of an NHS trust (Liverpool area I think) that was prosecuted for having an inadequate safety management system? Prosecution was under MHSWR r 5. Late 1990's(?!).

Any case names or dates are appreciated.

Is it Swindon & Marlborough NHS Trust you are thinking of ?

The Swindon and Marlborough NHS Trust was prosecuted in 1997 for a breach of Regulation 4 of the Management of Health and Safety at Work Regulations 1992. The Trust was charged with failing to make arrangements for ‘effective control of preventive and protective measures to ensure the health and safety of their employees’ (HSE, 1997). The Trust pleaded guilty and was fined £4,000 and costs of £1,720.80.
The HSE inspection was mainly concerned with looking at the management of health and safety and found that staff were not receiving suitable training, relevant policies and procedures were not in place despite having received Improvement Notices in the past and most importantly there was no consistent health and safety structure.
