Please can someone confirm the current situation regarding inspections of the lifting/lowering equipment on vehicle transporters.
I have been advised that currently these do not come under LOLER (just PUWER) but that the HSE is drafting proposals for these to require statutory inspections in the near future.

I am aware that there were various views on this subject and some organisations were hanging on to historic comments made by the HSE to save money but I thjought the HSE had cleared this up a couple of years ago.
Car transporters clearly are subject to examination under LOLER. The situation is very simple, if there was an incident could you sensibly argue in a court of law that the raised upper deck of a transporter did not constitute lifting equipment, I think this would be very difficult.

Thanks for that. I too had thought that LOLER was applicable until I spoke to an engineering inspection firm that stated otherwise.

you may find the HSE Contract Research Report [CRR] 429/2002 an interesting read. It describes various types of lifting equipment including vehicle recovery vehicles, in particular spectacle lifts. Whilst not exactly the same, the principles would apply. Given that the moving bed of a transporter would not normally be used, even inadvertently, for lifting persons then a 12 monthly thorough examination may be required.
