Does an employer need to have a written fire risk assessment if they employ less than 5 people?

In short yes, there is no mention of the number of people who must work in a premises only that an assessment must be done. It not only applies to workplaces but also places where members of the public have access such as shops etc.

Part 2 of the RR(FS)O article 9(6) states the responsibile person (probably the employer?) must record the assessment if they employ 5 or more employees. Therefore if the employer employs less than this they could decide not to record it. However I think best practice should prevail here and consider whether the respinsible person would want to rely on the defence that you conducted a risk assessment but did not record it.
9(7) goes on the prescribe the information which should be recorded.
You also need to consider what work activities are taking place and how that impacts on the level of risk.
Purhaps there are colleagues out there who are specilaists on the subject who could shed more light on the subject.

Thanks folks.
I thought writing it down would be the best option as it is not something that can be easily assessed and repeated on 'the fly' so to speak.

One thing that is often overlooked or misunderstood is that if the organisation employs more than 4 people then a fire risk assessment must be recorded for each workplace. So, for example, a chain of newsagents who have one employee per shop, if they have five or more shops then the organisation employs five or more so must have a written fire risk assessment for each shop.
