Posted By Harold Gbinije My Company is drawing up a no smoking policy. Could someone please clarify this issue for me. Does the smoking ban covers employees cars parked within the company premises and also when employees use their car for employers business.

Posted By Bob Youel your company can draw up what it wants provided its legal re rules etc - you dont need to rely on specific laws - many plants etc have had total no smoking bans for years - remember if your staff work in Wales/Scotland the rules are different so account for theses areas as well check other comments on this site for more info

Posted By James Perry Harold, Company is likely to be liable should an employee claim after slipping on ice in the car park. I would see that this is no different with regard to smoking. Regards Jim

Posted By Steve Cartwright Harold If your company wants to ban smoking on the whole of its site then it can include employees own vehicles whilst on the site. From a legal point of view the smoking ban covers all enclosed workplaces and all company owned vehicles. I can't wait. Steve

Posted By Tracey C Hi Harold, I look after premises in Scotland so we have had the ban there for 12 months now and we had to ban smoking in company vehicles and also display no smoking signs in them with details of who to contact if anyone observes someome smoking in the vehicle. If our staff are using their own vehicles for driving other staff around they are not allowed to smoke whilst the staff are in their car. I have a copy of the 'second hand smoking guidance for inspectors' if you want a copy give me a call. T
