Posted By J Knight Hi Folks, I know I usually bang on fairly strongly about banning smoking but I've had a thought. An enclosed workplace is defined as having a roof and being enclosed on more than 49% of its sides; well, consider a pyramid with an opening say a foot square at the top: it doesn't have a roof, does it? John

Posted By J Knight No, it doesn't have a roof, it has four walls which don't quite meet at the top and the resulting hole only lets some of the rain in, less than, for example, a bus shelter, John

Posted By Simon Shaw The walls are acting as a roof - the Regs say covering all or part of the structure: "roof" for the purposes of the regulation to include any fixed or moveable structure which is capable of covering all or part of the premises.
