Hi Folks,
I know I usually bang on fairly strongly about banning smoking but I've had a thought. An enclosed workplace is defined as having a roof and being enclosed on more than 49% of its sides; well, consider a pyramid with an opening say a foot square at the top: it doesn't have a roof, does it?

Yes its got a roof with a small hole cut into it - which will let the rain in and get everyone wet.

No, it doesn't have a roof, it has four walls which don't quite meet at the top and the resulting hole only lets some of the rain in, less than, for example, a bus shelter,

The walls are acting as a roof - the Regs say covering all or part of the structure:
"roof" for the purposes of the regulation to include any fixed or moveable structure which is capable of covering all or part of the premises.
