A friend injured their back at work in November but did not realise it was a serious injury until January. They underwent surgery this week but the incident has not been recorded in the accident book.

Can the event be recorded some 5 months after the accident? (There is a management witness who was present when the injury occurred.

Yes, I believe your friend should ask for the accident to be included in the accident book. It's irrelevant how long ago it happened - it's important that it's recorded that an accident at work happened which has caused him to be injured, so that his employer can review and alter working practices which were involved in his injury.

MT is quite correct request for the accident to be recorded and get the management guy to provide a witness statement, but don't rely on it if you are contemplating a law suit. Accidents should be recorded as soon as possible after the event even if there is no indication of ongoing problems such as operations to remediate problems. Employers need to know what accidents occurr in order to assess the efficacy of its safety management system and is not just for legal reason in cases of claims. I bet the employer has stated somewhere that all accidents must be reported!!! Not the company's fault the late reporting, it was the person who had the accident. Just one more thing, if a manager saw the accident why didi he not report it? Is ther something here not being told??
