Posted By philip wright if your employer has a contractor working on site and you have a accident due to negligence of the contractor who can you claim compensation from bearing in mind that the contractor has gone into liqiudation and thier insurance company will not pay out because the contractor should not have been working there due to an exclusion in the policy which forbids working at this particuliar site

Posted By Merv Newman your employer has primary responsibility for your Health and Safety.
You claim against them and they may then claim against the contractor.
If the contractor no longer has a legal existance (liquidation) then that is tough for your employer. Not for you.
