I have had a query from an employee about the duties on employers to provide shower facilities for night-shift workers.

I have checked Reg 21 of the Workplace Regs and there is no no distinction between day or night shifts.

The regs simply state that showers should be provided where necessary, and particularly for more strenuous work activities - as usual a wooly statement!

Can anyone advise on the definition of "where necessary"?

The site in question recently had a routine enforcement visit and the officer was satisfied with the welfare arrangements on site. So my view is that no extra arrangements are required for the night-shift.

"Where necessary" would include places of work that lead to employees being dirtier than they arrive, or possibly contaminated.

So: mines, lead plant, flour mills, oil refineries, quarries, etc., would all be fairly obvious.

Libraries, shops, offices, etc., less so.

If your workplace is dirty or the tasks particularly manual, it would be a good idea to provide showers - otherwise it is another facility just to be considered as you would others.

Think you also have to allow staf 10 minutes before the end of thier shift time to get showered, but cant remember which reg I read that in presume welfare regs

Although washing up time may be negotiated by TUs, I don't think it is in the legislation.
