We have a shunter in our yard driven by people with class 1 licenses, which is great. However, what is not great is that I have found out that occasionally they need to go from one yard to another, which takes them onto a public road for approx. 150 yards.

Whist this is on an industrial estate, I'm sure this is not good practice as I don't think that the shunter is MOT'ed and taxed (I will have to look into this to be certain).

What if the shunter would not pass an MOT? Does this mean that it's unsafe to use in the yard anyway - or is it unroadworthy (is there a difference?)

Any advice gratefully received.

We have a similar scenario with fork lift trucks and a 100 foot section of public road between two production areas, and movement of goods between the sites.

All vehicles that hit the road are deemed as on the public highway by our insurers and their requirements for us were to have all vehicles using that section of road to be totally within the law requirements for the Road Traffic Act, ie - taxed ,tested, and insured correctly.

Hi

I have a similar problem but not to do with the roadway, a shunter will fall under Provision Use of Workplace Equipment regs and they seem not to be cared for because it is "just a shunter" it should be inspected and records kept as with any other piece of equipment. Arguably even though it is not on the public highway perhaps they should have MOT type tests they are after all on a road, there are pedestrians and other road users present. If there was an accident how would you prove it was fit for purpose and or inspected and maintained competently.
