Under CDM07, with a term contract (with schedule of rates) what is the project, the term contract or the work package?

The CDM94 ACOP clarified, but the CDM07 ACOP doesn't. (Apologies to those who have also seen this question on HSE construction web discussion, but trying to get larger viewpoint)

This has always caused great discussion, with two schools of thought. One school treats the whole as a single project the other ignores the application of CDM completely in order to avoid the issues of construction phase plans and planning supervision etc.

The beauty of the new regulations is that the majority of the regulations apply to ALL construction work, not simply the notifiable. This change means that some form of formal planning etc has to be agreed for even relatively small works. The complexity of the plan will vary considerably but it still must exist in some form, even if only a single paragraph.

My approach to term contracts has therefore followed on from my previous practice which has been to set up what could be termed Contract Operations Manual which describes essentially the same material as the CPP, omitting the materials relevant only to notifiable projects. Remeber that the new reg 17 requires the client to maintain and update any H&S file. If no H&S file exists I would anticipate that a file of some description is created and maintained, covering the H&S File requirements, as work is done. Any notifiable projects can then be treated independently of this manual.

In principle, I'd tend to agree with Bob, otherwise it would be too easy to get sucked in to producing masses of repetitive paperwork.

Our approach on term contracts is to develop a single set of management arrangements and description of general on site risks - sort of a master construction phase plan - and then have individual project plans that only address the specific project arrangements and risks.

In respect of notification, we would tend to work out a rough plan for the year with the Client and then put in a single F10 at the start of the year (or their financial cycle). Only if something majorly different comes up would we submit an amendment.

Thanks for that, just to let you know what I didnt put in is that we are a client. we are willing to appoint CDM-Coordinator, do more comprehensive pre construction information, notifications etc if required, but not if we dont have to.

Please dont take this the wrong way, we plan and manage contracts/contractors all day every day but have come unstuck in conversations with one of our term contractors where we have opposing views!

I had rather assumed you were the client when forming my response. It is still better from the paperwork point of view to stick with a general management plan and only notify each large project when it becomes necessary.
