Does anyone know what the regulatory regime is with regard to H&S on the Isle of Man and specifically in relation to the control of asbestos in buildings?

My understanding is that IoM is a bit like Northern Ireland in that it has a H&S at Work order, but some statute is behind the UK. However they do generally use UK law as best practice.

Hi,

The IOM is not part of the UK or of the EU, it is a crown colony and has an affiliation with the EU. It has a version of HASAWA, but by and large doesn't have quite the same laws as EU derived UK equivalents.

However, it does have a good safety regime, and UK law is taken as persuasive evidence in Manx courts; they will have asbestos legislation. You should contact the IOM government for advice, most of their guidance etc is available free and I have found them very helpful.

My previous employer has a service on the Island, and I went there a fair few times; they followed UK law as best practice, something the relevant authorities in the IOM are very keen on,

Thanks Guys. I was really interested in whether there was any obligation to survey buildings in the manner required by the UK Control of Asbestos Regs. Having spoken to a senior H&S inspector. It would appear that this may only be needed prior to any works being carried out. Slightly different from the UK

You are correct, its nearly the same approach, perhaps more focused on managing risk as opposed to generating paperwork. Its a much smaller work population so it is adapted to local needs.

{It would be wrong to think the regulatory approach is less effective than the UK, there has been very successful prosecutions for those who have failed to manage and expose people to harm from asbestos}.

You can also call in to the office for a nice chat and a cup of tea.
