Sorry about this but I haven't been on this site for a long time, and this question may have cropped up before.

A friend is a truck driver spending most of the week in France and Spain. During this time he sleeps, eats and drinks in the cab of his vehicle.

Two questions:

There are many laws setting out working time limits. So outside these times is the vehicle still classed as a workplace? If not does the new smokefree law apply?

Can he smoke in the vehicle?

Dave, you're right there have been a number of discussions on this. Do a search of the forum to find more info/debate but in the short if the vehicle is used by more than one person, regardless of whether they are in the vehicle at the same time or not, then they have to be smoke free.

Clearly there are some jurisdiction issues here but most of the EU, I think, has similar legislation.

Your friends employer has the problem of enforcing this. I can't see that there's much his employer can do to stop a long distance lorry driver having a fag in his cab!

If he's outside the UK then UK laws don't apply, doesn't matter if it's about smoking or not! France and Spain do not have no smoking legislation for vehicles.
