Posted By StewartC This may have been covered before but here is my question We have an employee who has injured his arm - sporting accident - was signed off for 4 weeks but he is bored at home and wants to come into work (office environment)2 weeks left on the sicknote Question can he come into work ignoring the Doctors note or does he need to go back to the Doctor and get the note cancelled What would be the companies position in terms of insurance if he ignored the note and came into work. Thanks

Posted By CFT It is usual that he would be required to be 'signed' as fit to resume work. Not adhering to this could potentially create a 'can of worms' for you. CFT

Posted By Ian D. Hi StewartC I have had this situation very recently. I telephone the GP (and got to speak to him !) I explained the situation and the lite duties we had planned. He asked the employee to see him and signed him off that afternoon. This maybe just an example of a good GP, but it solved my issue. My advice is speak to the GP

Posted By Seamus O Sullivan Hi At present medical evidence says he is not fit for work. You cannot ignore this . Get the employee to produce a medical cert to say he is fit for the planned work. (You will owe him a greater duty of care) I would not rely on anything said by a doctor over the phone. Regards Seamus

Posted By nspencer As an Occupational Health Specialist, if an employee wishes to return to work earlier I would always get the GP approval in WRITING. Then any complications or problems then airse with fall with the GP who has cleared that person to work.

Posted By Pete48 Simple, it is the employees responsibility to make return to work possible if that is what the employee wants. How can you allow an employee to return to work against medical advice? Doctor has advised patient not to work for a period of time. Patient feels that is now too long a period. Patient must return to Doctor to discuss personal medical position and whether return to work is sensible. Either Doctor agrees and signs off or Doctor disagrees and patient stays off work. End of story.
