The Smoking ban has highlighted a serious problem within the hostels environment & care homes etc.
The problem is that the residents/tenants are now pushed into smoking within their own rooms and due to the nature of some of the clientel who have problems with drugs/alcohol abuse, they are unable to put out a fire if and when it starts.
We have already had an individual die from this, and therefore it concerns me to find am alternative solution.
It would be difficult to insist they did not smoke in their own rooms.

Hi Anwar,
You can have a smoking room for your service users in residential accommodation, or to put it another way the person in control of the premises can designate one or more rooms as smoking rooms, provided you don't let staff smoke in them. Guidance from DOH says that such rooms are for smoking only, but it is just guidance, and has not as yet been tested in court, and in any event I think maybe duties under HASAWA and RR(FS)O have some priority here, not to mention Care Standards Act 2000. One of our lawyers thinks the stipulation about no TVs etc in smoking rooms will be tested and will probably fail, though it will depend on the individual circumstances of the case of course.
Rock and hard place comes to mind; if people might die you could also consider automatic fire suppression (sprinklers); though people would complain it would stop them smoking in their rooms. I've had a quote of 50K for a 28 bed residential premises.

Hi again, just read my post and its a bit unclear (I know what I was talking about!). What I mean is, why haven't your residents got one or more designated smoking rooms? Its quite possible under the regs anywhere in the UK. The ban on TVs etc applies only to England, Scottish smokers in residential accommodation are quite welcome to watch Tricia while puffing away, and I don't know what the score is in Wales because we don't have any Care Centres or Hospices there so I haven't checked.
The bit about sprinklers is in case smoking rooms are impossible for some reason,

how about installing heat detectors (instead of smoke detectors) so there is automatic alarm activation in the event of a fire.
I would rpesume that smoke detectors wouldnt be a good idea in a room where people are allowed to smoke.
