The media is having a field day with health and safety today. Here we have a pub landlord who is conversant with the HSWA 1974!!!! Must be a first. An unusual defence should he get pinched by the no smoking police!!!

OK I really think this may run as what is the immediate risk and the lesser of two evils.

I know this may be daft but there is now good evidence and history which you can point to as part of a risk assessment not to enforce.

Bring in the smoking police (LA) and let them do the enforcement.
