does anyone know of any legislation about the number of workers required in a shop. my daughter works in a small department store as a supervisor. on a sunday she regularly has just 2 part timers on the shop floor (usually young people) and herself. when they have breaks there is only her and one other. she feels this is a health and safety issue as one member of staff on the till and one in the whole shop could make them easy targets for theft etc. she is getting more worried as the shop is busy on a sunday and her staff levels have not changed. looking for any help on this one thanks lesleyx

Hi Lesley,

There is no law that specifies staff levels.

However the organisation must undertake a risk assessment on hazards posed by their business. If lone working is an issue, there must be an assessment conducted and control measures put into place (i.e. emergency alarms by the tills etc). In addition employers must assess risks to young workers (under 18) and tell them what the risks are.

And don't forget she is entitled to a break herself. If she works over 6 hours she should get at least a 20 minute break. Often supervisors in such a situation work through their break because they don't want to leave the part-time workers on their own.
