Posted By D As already stated in a previous thread, we have taken a small unit in a shopping mall. We have been asked now by the landlord as the so called 'responsible person' to complete a fire risk assessment.We only have two employees. The landlord owns 21 units so is he the responsible person also to complete the Fire risk assessment or are we also responisble person and have to complete a fire risk assessment. I would appreciate further information.

Posted By Tony abc jprhdnMurphy You both have a duty under current legislation to assess the risk and put control measures in place. A sensible solution is to follow their lead with a joint muster point if needs be.

Check out the terms and conditions of your lease though as they may well have off loaded various health and safety responsibilities onto you (e.g. fixed wiring inspections, gas installation inspections and asbestos surveys).

Posted By Julian Wilkinson You both have responsibilities. Landlord for the whole of the site and should be communicated to you. You are responsible for adhering to the fire safety rules and procedures you must also carry out an additional fire risk assessment for the areas within your demise

Posted By Phillip You need to check your contract. It is possible there is a shared responsibility. The employer (you) responsible for the activities of your business. The owner (landlord) responsible for (say) the choice & maintenance of the building fire protection measures e.g. fire detection system. Therefore both parties need to have a suitable fire risk assessment in place. Hopefully the two should dovetail but if your assessment decides on more onerous protection measures than the landlord the responsibility for satisfying those requirements are yours.
