I know PPE has to be comfortable to wear, but if somebody refuses to wear any they try, on these grounds, could we get them to sign a disclaimer of some sorts, stating they are aware of the dangers involved in not wearing them, but are happy to continue in their current role. I have even sent them to try on numerous pairs at 2 local suppliers, during work time.

Disclaimers aren't worth the paper they are written on. If the risk assessment says PPE is necessary, then the employee concerned must be moved to a job away from the risk.

I agree with paul,
One problem is if one person does not wear ppe, will others do the same?,
how can managment supervise and dicipline one person for not wearing ppe when another does not wear it,,, you have to speak to employee and point out the dangers and the reasons s/he should wear the footwear,,, give examples of what may happen if he does not wear ppe, i would not go heavy handed with him, just let him know what will happen if his foot gets hurt, show him some pictures etc. usually people make up their mind quickly then.

of course if he will not then wear the ppe, you have more work to do.

If you have seriously tried all the options and none of them suit this individual then I suspect you may have grounds not to continue employing this personas you can't prtoect them -obviously you may need to look at redployment etc
