Posted By Emyr Evans How is the new act enforceable if a SME company (187 employees) does not have a director based in the UK?

Posted By Phillipe I would imagine the same rules would still apply but enforcing them may be more difficult if it came to it

Posted By Richard Altoft I guess he would be capable of being arrested if came back into this country and even subject to extradition from certain countries. He could be tried in absence and be banned from being a director, then without directors the company would fold or be subject to winding up by Company's House Could Be wrong R

Posted By Emyr Evans Richard,
My discussion was not aimed at UK citizens who either take up residence in another country - albeit, that does ponder another question if an UK director sets up a foreign company to run its operations in the UK
I was seeking advice on foreign companies (EU / American / Chinese etc. ) who do not have directors in this country & therefore would be extremely difficult to extradite to face man-slaughter charges - banning them as individuals from being UK directorship is not a serious threat.

Posted By Adrian Watson The act is not enforceable against individuals so it does not matter where the directors are located.
