I see another farmer has received helpful advice from the EA.

The waste regs and these type of situations need to be addressed immediately and the ludicrous sections removed,(they are only there so someone can nick you if something goes wrong,usually by interpretation), then actually have the persons who are most affected by this type of fly tipping agree on practical remedial procedures and put them in place.
This is a disgraceful situation for the EA to put a private individual in, then see the lunacy of it but do absolutely nothing to rectify the situation

Am at a total loss to know exactly what you are referring to and would not comment on the case.

In general terms however the strict liability of Env. legislation leads to a number of anomolies.

Work out the liabilities for a council employee removing material incorrectly placed in a garden waste bin and placing it on the verge before emptying the bin and driving off!!
