Posted By Robert S Woods I’m looking for legislation, guidance or other info to help me introduce a ban on the use of MP3 players. We have a number of employees who carry out fairly mundane duties and I don’t have a problem with them using them. It doesn’t increase the risks from their work. But now we have FLT drivers wearing them and complaining to the union that they are being victimised when they’re told they can’t wear them. The union safety rep is on my side but he still has to represent his members.
Can anyone help?
Yes there has been a risk assessment. I want to go down the route of education rather than blunt enforcement.

Posted By Amanda Firstly are the workers who are carrying out the mundane tasks in the same area as the FLT? If they need to be able to hear the FLT in operation. As for the FLT drivers they need to be fully aware of their surroundings when operating the FLT, if not they are putting others and themselves at risk. I think you may find guidance about this in the FLT operators training. I think you will need to address this promptly otherwise you will get a custom and practice situation which will be difficult to change. Education is all well and good but sometimes we need to be able to use the disciplinary route when H&S procedures are flouted, breached etc
