These regulations say that every worker has a right to 11 hours rest in every 24 hour period, does this mean if the employee wishes they can do more?

We had a similar problem last year.

I read the legislation, checked with online guidance and asked Croner.

Initially I went to down the line that workers must have 11 hours rest between shifts plus an additional 24 hours per week or 48 hours per fortnight and that there is no opt out.

However Croner advised that we can have a local agreement that must be voted on by secret ballot by all those affected.

regulation 5 only applies to regulation 4 in regard to the opt out, not regulation 10 requirements for daily rest breaks.

There is no opt out available for the minimum rest periods between shifts.

You well may have been ill advised.
