A contractor has unearthed some brown asbestos in the factory footings as they were preparing to install air conditioning.
They are organising a licensed contractor to deal with the asbestos but who is responsible for notifying HSE?
My P I Insurance does not cover me for advising on asbestos so I don't like to hazard a guess even if I am right!
More information will be appreciated.

I believe that the duty to report to the HSE lies with the ontractor, but check with the experts on 0870 850 4439

Crim, Richard is correct. The contractor is obliged to notify HSE at least 14 days prior to the commencement of the work, by means of a Form ASB5 accompanied by a Plan of Work or method statement and equipment specification. They also need to send a copy of their license.

Posted By Dave Wilson I know this may be teaching you to suck eggs, but just because it is brown asbestos it may not be a notifiable product, (It probably is so double check.) As if this particular ACM is non notifiable you may be able to save some money in that an unlicensed contractor may be used. Also the company may be able to claim back 125% of the cost of remediation (including survey and removal)as contaminated land and this includes buildings as well, but certain tax laws will have to be adhered to, see for more info http://www.hmrc.gov.uk/budget2001/revbn22.htm
