Posted By songwriter Can you please tell me who is reponsible for Agency drivers being trained, if he has an ADR but has not worked for anyone so therefore has minimum experience and starts working for our company for 3 days and has an accident. Is it the agency's responsibility or ours. thank you in advance.

Any contract worker should really only be accecpted to work on your premises if you feel that they are capable of performing their work safely.
That would take account of any external training record, experience gained with other companies, or not as the case may be.
Replace the agency tag with new starter, employed by you.
What training and awareness would you give that person?
Did you give the same to the agency worker, if not, why not?
Same tasks, same work location, only difference probably is pay scale amounts and tenure of employment.
He walks through your door to work, and you now have duty of care to maintain a safe system of working, including any on site training requirements that you feel would be necessary to prevent accidents or injuries from his normal work practice.
Very close to my heart at the moment as we have to sort out agency FLT drivers on a fairly regular basis for our sites, and we have to prove full control of their abilities and safety to our insurers and our co-workers.

Posted By Brian Welch I support the views of Gyln, and having just had and agency FLT driver incur a near miss, the investigation focussed very much on our ensuring the individuals competency and training prior to allowing use of FLT's on our premises.
Perhaps the only additionally comment would be not to forget Risk Assessments, which will identify mitigations such as SSW of PPE. Etc
