Anyone help?

Are operatives who using dump trucks with ROPS fitted required to wear seat belt regardless of terrain or is this not a requirement on level ground. Any pointers to the relevant documentation would be useful.

Unfortunately its all down to RA. If there is a possibility that a truck may overturn, then a seatbelt has to be fitted even when there is ROPS. (in fact even more so, so if it does turn over, the driver isn't trapped between ground and ROPS). If its fitted staff have to wear it.

Not to be contraversial but I would suggest that there is a possibility at any site of a turn over... So ROPS and seatbelt required!

HSG6 is the document you want, but you'll have to pay for it!!!

I would agree if it is a safety feature that the manufacturers fitted then it was part of their risk assessment that it is required. the only way around not neededing to wear them is if you can come up with a risk assessment that gives the reasons why not.

i thought there was a court case where a dumper truck overturned and the operator was not wearing the seat belt. he was either killed or seriously injured (he also was not qualified to drive but was helping the boss out)

According to Loler if there is a risk of overturning (terrain type, steep slope, ramp..) then you should consider seat restraints.
