Hi all,

Quick question regarding the storage of cleaning equipment (not materials) ie brooms, mops & buckets in the disabled toilet of a council owned recreation hall.

Apart from the not really suitable aspect, can someone point me in the right direction where I will find it in B & W that it is not allowed.

It is begining to make the toilet smell.

Hi Clive. Why are the toilets provided? Because the Council has to provide facilities for disabled people where reasonable. The need for toilets is self evident.

Why not store the mops and buckets in the passageway? Because they get in the way.

Why not store the mops and buckets in the Gents? Because they are unsightly and smelly.

Why store them in the disabled access toilets?

Pick a reason: nowhere else/cleaners don't use these toilets/convenient/nobody's told them not to/the toilets are "never used"/they won't mind/there's loads of room in there etc etc.

Find the real reason and deal with it.

Not sure that I can cite a specific legal reason not to store the offending articles there.

Just cite DOC and the problems it gives you in ensuring you are doing all that you can. On the other hand play the discrimination card " why discriminate against the disabled by storing cleaning gear in WC, what's wrong with non disabled," the answer therefore is find a proper storage area and the problem is cleaned up (sic) sorry.

Many thanks for your responses.

Deliberatly ommited the fact I am one of the Local Parish Councillors.

After a heated debate (over 1 hour) the council have at last decided to find an alternative (CCTV Cupboard) rather than the toilet.

Well, there's Reg 20 of the Workplace (Health, Safety and Welfare) Regs which states that sanitary conveniences must be kept in a clean and orderly condition. That's the reg I use when I want people to move their stock/hoover/ladder out of the staff toilet so that people can use it freely.

....you can always quote the Disability Discrimination Act, as you are:

"Discriminating against a disabled person..carrying out official business"

Cheers for the responses.

The kit has now been moved, for how long I don't know but as I am now in the process of writing a new set of SOP's, I will include Reg 20 of the WHSWR's.
