L73 A Guide to RIDDOR is the best place to start looking;
But the appriased version on incidents is
A dangerous occurrence is defined as something that happens which does not result in a reportable injury but which could have done. Those that may occur include:
* collapse, overturning or failure of load-bearing parts of lifts and lifting equipment * explosion, collapse or bursting of any closed vessel or associated pipework * electrical short circuit or overload causing fire or explosion * accidental release of a biological agent likely to cause severe human illness. * Dangerous occurrences involving the transport of dangerous goods
A dangerous occurrence must be reported within ten days with a completed accident report form.
Useless I'm wrong your one falls into the grey area
If in doubt its always best to report.
Other may have a different view to me, which is always welcome, its the only way to learn.

Posted By Arran Linton - Smith It is reportable. See paragraph 105 of L73 (‘A Guide to the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995’).
My experience with mini excavators is that they are often fitted with the wrong attachments, resulting in the plant being operated outside its design radius; therefore they are not stable in the first place.

Thanks, I stand corrected 105 is the place to look;
Lifting machinery (paragraph 1)
105 The definition covers the collapse of any of the machinery or equipment listed, THE OVERTURNING OF ANY SUCH MACHINERY OR EQUIPMENT or the failure of any load bearing part of it, WHETHER USED FOR LIFTING GOODS, MATERIALS OR PEOPLE. It does not cover the failure of ancillary equipment such as electric operating buttons or radius indicators.

Posted By Lee Daniels You don't say what caused it to overturn. Was it the result of a lifting operation in which case the previous advice is valid.
However, it could have been due to moving over uneven ground, slope, etc.

Posted By garyh I think it is reportable in that the overturning of an excavator is reportable as discussed above. Question is; is this an excavator?

Posted By Steven John Bateson You definately need to report this incident RIDDOR 1995, Schedule 2, part 1(e): 'The collapse of, the overturning of, or the failure of any load-bearing part of any excavator'. Also, in the definitions section, 'dangerous occurrence means an occurrence which arises out of or in connection with work and is of a class specified in paragraphs 1 - 17 of part 1 of Schedule 2' i.e. that part quoted above.
